Terms and Conditions for Month-to-Month and 36-Month Contracts
These Terms and Conditions (the “Agreement”) govern the services provided by TWK Communications to you (the “Customer”). By accepting our services, you agree to be bound by the following terms for both Month-to-Month and 36-Month contracts.
1. General Terms
1.1. By accepting our services, you confirm that you have read, understood, and agree to these Terms and Conditions.
1.2. TWK Communications reserves the right to modify these terms at any time. Any changes will be communicated to you and will become effective immediately upon posting.
2. Month-to-Month Contract
2.1. Equipment Ownership:
The Uplink and the free-to-use router provided by TWK Communications remain the property of TWK Communications for the duration of the contract.
2.2. Return of Equipment:
In the event of cancellation of the Month-to-Month service, the Customer agrees to return the Uplink and router to TWK Communications within 14 days of service termination. Failure to return the equipment may result in a penalty or charges equivalent to the replacement cost of the equipment.
2.3. Warranty:
The Uplink and router come with a 6-month warranty from the date of installation or service commencement. This warranty covers manufacturing defects or failure not caused by misuse or mishandling by the Customer. Callout and labour charges apply for replacement of equipment under warranty.
3. 36-Month Contract
3.1. Equipment Ownership:
During the term of the 36-Month contract, the Uplink and router remain the property of TWK Communications.
3.2. End of Contract:
Upon successful completion of the 36-month contract, ownership of the Uplink and router will transfer to the Customer.
3.3. Warranty during the Initial 36-Month Term:
The Uplink and router provided under the 36-month contract are covered by a full warranty for the duration of the 36-month contract. This warranty covers any manufacturing defects or equipment failures not caused by misuse or mishandling by the Customer. Callout and labour charges apply for replacement of equipment under warranty.
If any defects or issues arise during the initial 36 months, TWK Communications will repair or replace the equipment at no additional charge, provided the equipment is returned in accordance with the warranty terms.
3.4. Warranty Extension:
At the end of the 36-month term, the Customer has the option to sign up for a new contract, including the option to extend the warranty on the equipment (This includes the Uplink and standard Wi-Fi router installed). If the Customer does not wish to extend the warranty, the standard manufacturer’s warranty terms will apply.
4. Equipment Usage and Care
4.1. The Customer agrees to use the provided equipment in accordance with all applicable laws and regulations and not to tamper with, modify, or damage the equipment.
4.2. The Customer is responsible for the proper care, maintenance, and protection of the equipment while it is in their possession, including ensuring that it is used only for its intended purpose.
5. Cancellation and Termination
5.1. Month-to-Month Cancellation:
The Customer may cancel the Month-to-Month service at any time with 30 days written notice.
Upon cancellation, the Customer must return the Uplink and router to TWK Communications as per the terms outlined in Section 2.2.
5.2. 36-Month Termination:
If the Customer terminates the 36-month contract before the end of the term, they may be subject to early termination fees or penalties, as specified in the contract.
The Customer must also return the Uplink and router if the service is terminated early before the equipment ownership transfer.
6. Liabilities and Indemnification
6.1. TWK Communications is not responsible for any loss, damage, or injury resulting from the use or misuse of the equipment provided under either contract.
6.2. The Customer agrees to indemnify and hold TWK Communications harmless from any claims, damages, or liabilities arising from the Customer’s use or handling of the equipment.
7. Miscellaneous
7.1. Governing Law:
These Terms and Conditions shall be governed by and construed in accordance with the laws of South Africa.
7.2. Dispute Resolution:
Any disputes arising from or related to this Agreement shall be resolved through Legal process in the jurisdiction specified above.
7.3. Severability:
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remainder of the provisions shall remain in full force and effect.
7.4. Entire Agreement:
This Agreement constitutes the entire understanding between the Customer and TWK Communications and supersedes any prior agreements or understandings, whether written or oral, regarding the subject matter hereof.
By accepting the services of TWK Communications, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of this Agreement, please contact us before proceeding.
